New Rule Extends Overtime Pay Eligibility to 4.2 Million More Employees

Are you a salaried employee? If so, you need to know about the new rule regarding overtime pay.

The U.S. Department of Labor issued a new rule that will make an additional 4.2 million salaried employees eligible for time-and-a-half pay for every hour worked over 40 in a week.

The rule was issued in May, and employers currently have until Dec. 1 to comply. Specifically, the rule raises the salary threshold for employees who are exempt from overtime pay.

Before the rule change, if you were a salaried employee, you were exempt from overtime pay if you earned more than $23,660 a year. But starting in December, if your salary is $47,476 or less, you are eligible for overtime pay.

The problem is that many employees are not aware of their rights.

While the new rule is a boon to salaried workers -- and also long overdue -- many people who are categorized as executive, administrative or otherwise professional employees are not aware that they are due overtime wages.

If you are unsure of whether you should be getting paid 1.5 times your regular rate for every hour you work beyond 40, then contact an employment law attorney to get some answers. Your employer may not be aware of the rule change, or maybe your employer is simply unwilling to comply.
